Welcome to Telmai Inc. (“Telmai,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your use of our website, products, and services (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms.

By accessing, browsing, or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Product and Service Offerings

Telmai provides data observability and data quality monitoring services, including automated monitoring, anomaly detection, incident management, and data trust signaling across modern data platforms and cloud environments.

3. User Accounts

To access certain features of our Services, you may be required to create an account. Where Telmai is deployed within a Microsoft Fabric environment, access is governed by your organization’s existing Microsoft Entra ID credentials and Fabric workspace permissions. In all cases, you agree to:

  • Provide accurate and complete information when creating an account.
  • Maintain and promptly update your account information.
  • Be responsible for safeguarding your credentials and all activities conducted under your account.

4. License and Intellectual Property

Telmai grants you a limited, non-exclusive, non-transferable license to use the Services for your internal business purposes. All rights, title, and interest in and to the Services, including all intellectual property rights, remain with Telmai. No rights are granted beyond what is expressly stated in these Terms.

5.  Use Restrictions

  • Use the Services for any unlawful purpose or in violation of any applicable laws or regulations.
  • Modify, adapt, translate, or reverse engineer any part of the Services.
  • Access the Services through unauthorized means, including automated systems not expressly permitted by Telmai.
  • Attempt to access, extract, or transmit data from tenants or workspaces other than your own.

6. Privacy and Data Protection

Our Privacy Policy describes how we collect, use, and protect your data. Telmai processes only the metadata and structural information necessary to deliver the Services. Raw data values are not transmitted outside your environment. By using our Services, you consent to data handling as described in our Privacy Policy.

7. Payment and Subscription Terms

Telmai offers tiered subscription plans, including a free trial, usage-based tiers, and enterprise arrangements. Applicable fees are determined by your selected plan and, where applicable, by consumption-based metering through supported marketplace channels. 8. Service Modifications and Termination

Telmai reserves the right to modify or discontinue any part of the Services at any time, with or without notice. We may terminate or suspend your access to the Services if you violate these Terms or if required by our obligations to third-party platform providers.

9. Limitation of Liability

To the maximum extent permitted by law, Telmai shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of or inability to use the Services.

10. Indemnification

You agree to indemnify and hold harmless Telmai, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising out of your use of the Services or your violation of these Terms.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any disputes arising from or relating to these Terms shall be resolved through binding arbitration under the rules of the American Arbitration Association (AAA), to be held in Texas.

13. Changes to the Terms

Telmai may update these Terms from time to time. If we make material changes, we will notify you by posting the revised Terms on our website. Your continued use of the Services after any such change constitutes your acceptance of the revised Terms.
